The measures provided for in the North Rhine-Westphalian Corona Protection Ordinance are "currently presumed lawful", the Higher Administrative Court in Muenster declared on Tuesday. The decision is unappealable.

A woman from Bonn had appealed against the obligation because she thought the regulations were disproportionate, the Higher Administrative Court explained. She could only maintain social contacts to a limited extent and could no longer meet with several friends in public as she used to. The applicant had informed the court that this placed a heavy psychological burden on her. In addition, the obligation to wear a mask was in her opinion neither suitable nor necessary.

The Higher Administrative Court rejected the application for a temporary injunction. According to the court, the restrictions on meetings and the observance of the minimum distance were intended to limit the risk of infection despite the gradual opening of social and economic life. According to current knowledge, the virus spreads primarily via droplets from person to person. Against this background, the court stated that the encroachment on the right of personality was justified. The same applies to the obligation to wear masks. In addition, it was still possible to maintain social contacts.
